Welcome to PixAura. By downloading, installing, or using the PixAura application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Description of Service
PixAura is a visual creation workflow application that helps you discover images from Pixabay or capture photos with the camera, manage projects, edit images, create layouts, and export content to your photo library. The App supports English and Simplified Chinese.
Core workflow: Discover / Camera → Add to Project → Edit / Compose → Export
2. Eligibility
The App is suitable for users aged 4 and above (or the minimum age required in your jurisdiction). By using the App, you represent that you meet this requirement.
3. Pixabay Content
The App uses images and media from Pixabay. All content displayed through the App is sourced from Pixabay and is subject to the Pixabay License, which permits free use for commercial and non-commercial purposes without attribution (though attribution is appreciated).
- You are responsible for complying with Pixabay's terms and license when using content obtained through the App.
- PixAura does not own or license Pixabay content; Pixabay is a third-party service.
- The App provides links to Pixabay for source attribution and further information.
4. Your Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Use the App to distribute malware, spam, or harmful content.
- Circumvent any technical limitations or security measures of the App.
- Use the App in any manner that could damage, disable, or impair the App or any third-party services.
5. Intellectual Property
PixAura and its branding, design, and software are the property of the App developer. The Pixabay name, logo, and content are the property of Pixabay GmbH. You do not acquire any ownership rights in the App or its content by using the App.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure.
- The Pixabay API or any third-party service will be available at all times.
- Results obtained through the App will meet your expectations.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIXAURA AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY, OR ONE HUNDRED UNITED STATES DOLLARS (USD $100), WHICHEVER IS LESS.
8. Third-Party Services
The App integrates with third-party services, including:
- Pixabay – Image search and download. Subject to Pixabay Terms of Service.
- Apple Services – Photo library, camera, system share sheet, and other iOS features. Subject to Apple's terms and policies.
Your use of these services is subject to their respective terms and privacy policies. PixAura is not responsible for the availability, content, or practices of third-party services.
9. Changes to the App and Terms
We may update the App or these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review the Terms periodically. Material changes may be communicated through the App or via the feedback email.
10. Termination
You may stop using the App at any time. We may suspend or discontinue the App or your access to it without prior notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) shall survive termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is located, without regard to conflict of law principles.
